Duncan is a Senior Associate in the firm’s Washington, DC office. He is a skilled federal litigator with over a decade of experience, representing employers, the government, and individuals.
He joined Klasko Immigration after serving as a Trial Attorney with the U.S. Department of Justice’s Office of Litigation. He is a key member of Klasko’s Federal Litigation and EB-5 Teams, where he applies his litigation background to advance client interests in complex adjudications, and agency challenges. Duncan brings a rare and powerful combination of deep litigation acumen and corporate immigration insight, enabling him to effectively navigate both courtroom strategy and business immigration planning with precision.
Duncan’s litigation experience is wide-ranging: he litigated more than 100 immigration cases for DOJ’s Civil Division and was a Staff Attorney at the U.S. Court of Appeals for the Fifth Circuit, the Board of Immigration Appeals, and the Atlanta Immigration Court. He also served as a law clerk for U.S. District Court Judge Eldon Fallon, in the Eastern District of Louisiana. Duncan has successfully argued in the U.S. Court of Appeals for the Second, Seventh, Ninth, and Tenth Circuits.
Early in his legal career, Duncan practiced at a nationally regarded immigration law firm, where he represented employers and individuals regarding H-1B, L-1, O-1, EB-1, EB-2, PERMs, and NIW petitions. His clients spanned diverse sectors, including higher education, medicine, science and research, manufacturing, technology, engineering, the arts, oil and gas, and general commerce. His ability to translate complex business needs into immigration strategy complements his litigation credentials – making him an invaluable advisor to clients navigating both policy and process.
He has trained hundreds of private-sector and government immigration attorneys and Immigration Judges for the Federal Bar Association and the DOJ Civil Division’s annual immigration conference. He has been admitted to practice in the regional federal circuit courts and the U.S. Supreme Court.
Duncan is passionate about helping his clients protect their legal rights through administrative advocacy, litigation, and appeals, as necessary to achieve their goals. In his spare time, he enjoys cycling, hiking, and spending time with his two daughters.
Duncan speaks Spanish and basic Portuguese. Duncan graduated magna cum laude from Tulane Law School, where he was a member of the Order of the Coif and was a Managing Editor of the Tulane Law Review. He was a student attorney at the Tulane Civil Litigation Clinic. He obtained his B.A., magna cum laude, in Spanish & European Studies from Vanderbilt University.
