Client Alert: President Biden Set to Limit all Inbound Travel from India
Several media outlets have reported that, effective May 4, 2021, the Biden Administration will be restricting most inbound travel to the U.S. from India.
The impending India travel ban has yet to be issued, but we expect it to be similar to the travel ban the President issued earlier this year for South Africa and to those issued by former President Trump with respect to China, Iran, the Schengen Region, and the UK. We expect that the U.S. will be banning all travel for any person physically present in India within the prior 14 days. We also expect that U.S. citizens, parents of minor U.S. citizens, spouses or U.S. citizens, and lawful permanent residents will not be subject to the bans.
As with prior travel bans, we anticipate that the India travel ban will contain limited exceptions for individuals whose presence in the U.S. is related to the containment or mitigation of the COVID-19 pandemic, and other national interest exemptions.
The new travel ban would be in addition to other measures taken in response to COVID-19 levels in India we covered earlier this week, namely that the U.S. Embassies and Consulates in India have severely restricted the availability of routine visa services and visa renewals through the lockbox mechanism.
