USCIS Releases New Two Page Form I-9

Today, USCIS officially released the long-awaited form through Notice in the Federal Register. The new Two Page I-9 has a revision date of 03/08/13.

While the USCIS has advised that employers should now begin using the newly revised Form I-9, there is a 60 day grace period. Employers may continue to use previously accepted revisions (Rev. 02/02/09) N and (Rev. 08/07/09) Y until May 7, 2013. After May 7, 2013, employers must only use the newly issued Form I-9 (Rev. 03/08/13).

The Form itself has been expanded to two pages and there are fields for additional information including, for example, optional fields for employee e-mail addresses and telephone numbers as well as foreign passport information in Section 1 (if applicable). The form’s instructions have also been significantly revised.

USCIS has stated that a new “Handbook for Employers, Guidance for Completing the Form I-9 (M-274)” is currently being updated, and is expected to be released next week.
