Federal Contractors Will Be Required to Use E-Verify

On June 6, 2008, President Bush issued an Executive Order amending Executive Order 12989 requiring contractors, as a condition of each future federal contract, to agree to use an electronic employment eligibility verification system designated by the Secretary of Homeland Security to verify the employment eligibility of all persons hired during the contract term and all persons performing work within the United States on the federal contract.

DHS Secretary Michael Chertoff subsequently designated E-Verify as the system of choice. Proposed implementing regulations were published in the Federal Register on June 12, 2008. There is a sixty day comment period on the proposed regulations. The proposed regulations can be found at the following link: http://edocket.access.gpo.gov/2008/pdf/E8-13358.pdf.
